CMS Does Not Finalize Gainsharing Proposal

October 31, 2008 - CMS has released the Outpatient Prospective Payment System and Physician Fee Schedule Final Rules. Included in the Physician Rule was CMS’ decision not to finalize its proposed gainsharing exception which would have hampered patient access to innovative medical technologies.

Throughout the process, MDMA worked with many decision makers, including CMS and Congress, to educate them on the negative consequences of gainsharing arrangements. MDMA is pleased that CMS did not move forward with this proposal.
