MDMA Sends Patent Stakeholder Letter to Congressional Leadership

MDMA and a coalition of stakeholders sent a letter to House and Senate leadership this week expressing concern over reports that application fees paid to the United States Patent and Trademark Office (USPTO) are being diverted from their intended use. The letter stated that if reports are accurate and fees are being diverted from USPTO to general government spending, it’s a clear violation of the America Invents Act (AIA).

AIA set up a Reserve Fund to ensure all fees paid to USPTO would remain at the USPTO; however, some are reporting the Office of Management and Budget (OMB) has decided to override AIA as sequester related across-the-board spending cuts are causing agencies to look for funds elsewhere. The reported overreach by OMB amounts to $148 million in fees and threatens USPTO’s ability to protect innovators and continue its progress towards reducing patent pendency.
